Well, according to the US Copyright Office, it can, but not without a human touch. In order to qualify for copyright protection, a meaningful amount of creative effort must be proven to have been put in by a human.

Thanks to AI-generated software, creating artwork and text instantly has never been easier. But as demand for copyright protection increases, so too does the need to determine what can and cannot be protected.

Looks like we still need some non-artificial intelligence to keep us in check.

The US law has some interesting stipulations about copyright. It states that only works that were created by humans using their creativity can be copyrightable. This means that machines and AI algorithms are not recognized as authors, and their creations cannot be protected by copyright laws.

This includes all those amazing digital art, poems, and books that were generated using tools like DALL-E, Stable Diffusion, Midjourney, ChatGPT, and the newly released GPT-4.

USCO director Shira Perlmutter has warned that your AI-generated creations are at risk of not being protected by copyrights if they were made using only a text description or prompt.

So, if you want to claim copyright on your digital art, the US Copyright Office (USCO) says you need to add a touch of humanity to make it truly yours.

The USCO suggests sprucing up your AI-generated image with edits and adjustments so that your final product feels less robotic and more human. It's a reminder that although technology can do amazing things, nothing beats the creativity and passion of a real human artist.
